Of Counsel Prof. Avv. Massimo Foglia

He is associate professor of private law at the University of Bergamo (Department of Law), where he teaches Private Law and Legal Writing. At the University of Bergamo, he has also taught Family Law, Advanced Private Law (with a focus on contract law), European Contract Law and Emerging Technologies Law.

Thanks to an academic path of constant legal research, carried out in Italy and abroad, Massimo specialized in corporate and commercial law, national and international contract law, European private law, new technologies law, personal rights and tortious liability.

  • He gained considerable professional experience at the international firm PLUTA GmbH, where he worked on national and international contracts as well as corporate and commercial law. He is the author of numerous publications on contract law, with particular reference to business contracts, including the monographic work Il contratto autoregolato: le merger clauses, Giappichelli (2015), winner of the "Francesco Santoro-Passarelli 2017" prize bestowed by the Accademia dei Lincei in the field of Civil Law and the Scientific Excellence Prize of the Italian Society of Civil Law Scholars; and the edited work Il contratto "apolide". La contrattazione transnazionale nel mercato globale, Edizioni ETS (2019). He teaches contracting at the Advanced Training Course in "Cleaning Management" at the School of Management of the University of Bergamo.

  • He has worked on digital law, e-commerce and personal data protection. He has assisted several start-up companies in the start-up phase, advising in the implementation and compliance phase of apps and corporate websites, drafting terms and conditions of e-commerce and marketplaces, also taking care of their privacy aspects. He has taught Emerging Technologies Law at the University of Bergamo and Introduction to Digital Single Market in the Master en droit des affaires - Droit du marché digital et des données at the Faculté de Droit - Université Catholique de Lyon.

  • On the subject of tortious liability and personal rights, with particular reference to medical liability, he is a lecturer in the Master in "Management of Hospital Companies" (co-designed with the San Donato Hospital Group) at the School of Management of the University of Bergamo, and in the Master in "Case&Disability Manager" at the School of Higher Education of the University of Bergamo. He also held the course in Ethics and Law at the School of Medicine of the University of Milano-Bicocca. He has held teaching and training positions for healthcare personnel at prestigious healthcare facilities and research centers, including the ASST Papa Giovanni XXIII in Bergamo, the Azienda ospedaliera in Padua, the Aviano Oncology Reference Center, the Health and Research Foundation in Rome. He is the author of the monograph Consent and Care. Solidarity in the therapeutic relationship, Giappichelli (2018), in which the issues of informed consent, medical liability, administration, living will and end of life are explored in depth. He has published essays and articles, in Italy and abroad, on medical liability from misdiagnosis, violation of the rules of informed consent, voluntary interruption of pregnancy and damage from unwanted birth, pharmaceutical company liability and clinical trials of drugs. On the latter topic, he has been a speaker at national conferences organized by renowned pharmaceutical companies.

  • PhD in Private Law in the European Dimension at the University of Padua.
